Terms of Service

These terms apply to the use of Sales Desk ("the service"), operated by Davar Real Estate & Consultancy ("we", "us"). By creating an account, accepting an invitation or using the service, the company you act for ("the customer") and you agree to them.

1. The service

The service helps property developers manage their projects, payment plans and leads, answer clients on WhatsApp, Instagram and Facebook Messenger, send WhatsApp broadcasts, and, if switched on, use an AI assistant. Features may change as the service develops. During early access the service is provided as it is, without a promise of uninterrupted availability.

2. Accounts

• The customer's manager invites staff and decides their roles. The customer is responsible for who has access and for keeping passwords private.
• Information given to us must be accurate.
• Tell us straight away if you believe an account has been misused.

3. The customer's responsibilities

• The customer is responsible for the content it puts into the service (projects, prices, plans, messages) and for keeping prices and availability correct.
• The customer must have the right to contact the people it messages. Broadcasts must follow WhatsApp's Business and Commerce Policies; people who ask to stop must not be messaged again.
• The customer must follow the rules of Meta (Facebook, Instagram, WhatsApp) and the laws that apply to its business, including consumer protection and data protection laws.
• The customer must tell its clients, in its own privacy notice, that their messages are handled with this service.

4. Acceptable use

The service must not be used to send spam or unlawful, misleading, abusive or discriminatory content; to collect data without permission; to try to reach other customers' data; or to interfere with the service or with Meta's or Google's systems.

5. The AI assistant

The assistant writes replies with Google's Gemini model. Prices, payments, sizes and codes in its replies are filled in from the customer's own data, and replies it cannot back with that data are handed to a person. Even so, an AI assistant can misunderstand a client. The customer remains responsible for what is said to its clients, should review the assistant's conversations, and can switch it off or take over any conversation at any time.

6. Other platforms

The service depends on Meta and Google. Their rules, prices, approvals and availability are outside our control; for example, WhatsApp message charges are billed by Meta to the customer's WhatsApp account. If a platform suspends a page, number or app, the related features may stop working.

7. Data

The customer owns its data. It gives us permission to store and process that data only to provide the service. How we handle personal data is described in the Privacy Policy. When the customer's account ends, its data is deleted or anonymised as described there.

8. Fees

Fees, if any, are agreed with the customer separately. Early-access use may be free and may end with notice.

9. Suspension and ending

The customer can stop using the service at any time. We may suspend or end access if these terms are broken, if required by law, or if a platform requires it; where reasonable we will give notice first.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost sales, or for the acts of Meta, Google or other third parties. Our total liability is limited to the fees the customer paid us in the three months before the claim (or, if none, to one hundred US dollars).

11. Changes to these terms

We may update these terms. The date at the top changes, and customers are told of significant changes before they take effect. Continuing to use the service means accepting the updated terms.

12. Law

These terms are governed by the laws applicable in the Kurdistan Region of Iraq, and disputes are handled by the competent courts of Sulaymaniyah, unless the law requires otherwise.
